Nepal: Independent Apex Court exonerates Hotelier Piyush Amatya

Nepalese population can still repose trust on Nepal’s Independent Judiciary.

The Nepali Judicial system is not only an independent one but also possesses penetrating eyes which allows the Institution to award justice while going through various cases.

Finally, Piyush Bahadur Amatya, the Chairman of The Fulwari Resort Hotel, Pokhra has been awarded to what he deserved.

Mr. Amatya, though had to undergo through immense mental torture for over a year plus but yet the Nepal’s Supreme Court just the other day, August 24, 2012, to be more precise, made a verdict in favor of Mr. Amatya wherein the Court comprising of the bench Chaired by Honorable Justices Damodar Sharma and Tark Raj Bhatta, stated that Mr. Amatya need not deposit the bail amount and rest of the court cases made against Amatya be cleared at the earliest. Amatya is now a free man. He has now been exonerated from the fraudulent charges by the fresh Honorable Court verdict.

Mr. Amatya was dragged to the court when opinions differed in between the Resort Hotel and the Casino being operating inside the Hotel premise. The casino authorities claimed that they were duped by the Hotel management in millions and millions which encouraged the Hotel management to register a case of fraud on behalf of the Hotel against Dip Bahadur Basnet of the Casino gaming Company at the Kaski District Police Office some two years ago. It was a case registration in self defense.

However, the Police officials did not take the matter seriously thus adding more mental pressure on the internationally acclaimed Hotelier, Mr. Amatya.  

The case later took a surprising turn. In effect, those who had been blamed by the Hotel themselves registered a case of fraud against Mr. Amatya. The Kathmandu police initiated the case against Amatya.

The fact is that last year around this time (July middle or end 2011) when the post of the Nepal Home Minister had remained in a vacant state, Minister Prabhu Sah, the then Law Minister, put excessive pressure on the Nepal Police and then began the ordeal of Mr. Amatya.

Informed sources opine that a section of the Nepal police too came under the heavy influence of the Minister Prabhu Sah for some mysterious reasons.

During the legal discussion that followed after registering of a case of fraud against Amatya, the legal experts had opined that when two separate companies vow to work together through a written agreement that is binding on both the contracting parties then in such a situation the entire transaction could not be taken as a case of fraud.

The Supreme Court in the process of providing verdict in this case has also nullified the ruling(s) made by the Kathmandu district and the Patan Appellate Court.

Justice though delayed yet it was a fair one eventually.

The prestige and popularity of Nepal’s Apex Court definitely has gone up.
