Nepal apex Court caps CA term extension ploy

The Supreme Court of Nepal has closed all legal possibilities to extend the term further of the money spinning and almost defunct Constituent Assembly.

CA is already in ventilator with the fresh Supreme Court ruling.

A full five member bench of Nepal’s Supreme Court including Chief justice Khil Raj Regmi, November 25, 2011, in its verdict over the fate of Constituent Assembly had declared that the term could only be extended “for the last time and that too for six months only”.

Some Unified Maoists Party leaders and Madhesi leaders had criticized the SC decision for what they claimed direct interference of the judiciary in the matters exclusive to the legislative.

The Supreme Court Registrar’s Office had later rejected the separate pleas forwarded by the Prime Minister’s office and Chair of the Constituent Assembly Subash Chandra Nembang to review the November 25, 2011 decision to limit CA term to last six months.

A single bench comprising of justice Kamal Narayan Das on Wednesday March 28, 2011, has thus validated the decision of the registrar’s office to extend the CA term.

Thus CA is counting its last breath. The frustrated population have won the game which began right with the signing of the NOIDA 12 point agreement.

Judicial supremacy prevails.
